Antigua Moves Closer to Securing Title to Salinas Golf Desalination Plant Site
This initial ruling grants the ownership of the parcel to the Municipality of Antigua against the bankruptcy administrator of the company Ramiterra, S.L.
“After a lot of work by the municipal legal services,” says Mayor Matías Peña García, “we achieved an important victory in the reception procedure of the Las Salinas urbanization, sector 9 of the PGOU,” the mayor notes, “receiving the first‑instance judgment from the Administrative Litigation Court that grants ownership to the Municipality of Antigua of the service parcel on which the desalination and water‑treatment facilities are located.”
“From the City Hall we defend in the courts, with hard and complicated work for which I congratulate the Secretary, the Architect and the municipal legal services,” adds Matías Peña, “that this service parcel must be publicly owned.”
The Municipality of Antigua maintains before the bankruptcy administrator of Ramiterra, S.L., that this parcel must be transferred obligatorily and free of charge as established by urban‑planning regulations for lands necessary for roads, open spaces, green areas and public facilities serving the development area in which their lands are included, as is the case of the mentioned parcel with technical infrastructures that support urban services for citizens, such as water supply and treatment.
The Municipality of Antigua requested the mandatory opinion of the Canary Islands Advisory Council, which was favorable to the municipal proposal, supporting the council regarding the ownership of the parcel. That agreement was appealed by the bankruptcy administrator, and a first‑instance judgment has now been issued by the Administrative Litigation Court, again favorable to municipal interests, dismissing the appeal filed by the bankruptcy administrator on behalf of Ramiterra S.L.
Despite these warnings and ongoing administrative and judicial procedures, municipal legal services point out that the parcel has been put up for auction together with the other assets of Ramiterra, S.L. Consequently, the Municipality of Antigua has filed a bankruptcy incident before the competent Commercial Court requesting:
- the exclusion of that parcel from the auction, and
-, as a precautionary measure, the suspension of the auction of the lot in which it is included,
in order to safeguard municipal interests and ensure compliance with the court’s judgment.
