La Oliva's new noise ordinance tightens penalties and ramps up inspections

The La Oliva City Council is updating a 30‑year‑old regulation, raising the maximum fine from 100,000 pesetas (≈ €600) to €3,000. The draft, now in public consultation, adds anti‑noise rules, stronger enforcement, updated penalties and a requirement for sound‑limiting devices.

The La Oliva City Council has opened a public‑information procedure for the new municipal ordinance on noise and vibrations, initially approved by the plenary on 27 November. The new text aligns local regulation with the national Noise Law and its implementing regulations, incorporating modern criteria for control, inspection and sanctioning.

The 1992 ordinance, still in force, regulated sound levels with technical references that are now outdated and imposed penalties expressed in pesetas. It also lacked modern acoustic‑control tools. The new law expressly repeals that text and establishes a framework consistent with the Technical Building Code, Law 37/2003 on Noise, and Royal Decree 1367/2007.

Main Changes Compared with the 1992 Ordinance

  • Reference values: Limits for noise and vibrations are now tied to current national standards, abandoning the fixed tables used in 1992.
  • Acoustic quality objectives: Area‑specific targets are introduced, allowing temporary suspension of official, cultural or religious events after an impact assessment.
  • Mandatory sound‑limiting devices: Acoustic limiters/recorders become compulsory in venues with music or audiovisual systems that can be volume‑manipulated.
  • Impact studies: Operators of classified activities and public spectacles must submit acoustic‑impact studies or sound‑proofing projects.
  • Enhanced civic conduct rules: The ordinance strengthens the classification of noisy street gatherings, improper use of music equipment in vehicles and repeated incivil behaviours, no longer requiring technical measurements when the disturbance is evident.

Inspection and Updated Penalty Regime

  • Inspection authority: The text creates a dedicated inspection chapter, recognizing inspectors and the Local Police as authority agents, governing inspection reports and granting them a presumption of truth.
  • Immediate provisional measures: Authorities may seal equipment or suspend activities in cases of serious limit breaches.
  • Fine structure (in euros):
    • Light offences: €120 – €750
    • Serious offences: up to €1,500
    • Very serious offences: up to €3,000, plus possible temporary closures.
    • By comparison, the 1992 ordinance capped fines at 100,000 pesetas (≈ €600) and lacked this graduated scale and detailed precautionary measures.

Remaining Steps Toward Final Approval

After the public exhibition of the draft in December and the resolution of all received comments and suggestions, the municipal plenary must debate and adopt the ordinance, first provisionally and then definitively, before it comes into force.
