title.El Patio del Cuartel contract sealed and terminated over concession flaws

.# Sealed and Contract Terminated for “El Patio del Cuartel” Due to Concession Deficiencies

The municipal council of Puerto del Rosario has sealed and begun the termination of the concession contract for the establishment known as El Patio del Cuartel, a bar‑café operating in Plaza Pública Millares Sall, in the El Charco neighbourhood.

The owner, Álvaro Sanz, has denounced “persecution” after organising a protest and posting his version of events on social media. Mayor David de Vera responded in the plenary session on Monday and the council also issued an official statement.

Mayor’s Explanation of the Closure

During a question from councilor Miguel Felipe Rastrero (elected by Vox, now with the PP), the mayor outlined the reasons for the closure, citing a series of breaches identified in a report prepared by the contract officer, in which “the deficiencies are clearly evident.”

“The contractor has failed to pay the concession fee, has not provided a valid civil‑liability insurance, lacks the necessary staff and material resources required by the tender, and is missing essential hygienic‑sanitary, safety and health training,” the mayor said.

Additional shortcomings listed by the mayor include:

  • No registration in the General Food Business Register.
  • Failure to present a certification of sexual‑offense offences.

Sealing and Contract Termination

The opposition’s mixed‑group councilor asked how the concession was initially granted if the required conditions were not met. The mayor clarified that the file was opened between September and October 2025, but it only covered the allocation of the land (Plaza Millares Sall). Licensing and the classified activity were the responsibility of the concessionaire.

The mayor recapped the successive documentation requests made by the municipality from October 2025 to January 2026, which received no response until after the premises were sealed on the 19th.

  • Initial deadline: ten days.
  • Result: With documentation still incomplete after sealing, the municipal contracting service initiated the resolution of the contract, i.e., the revocation of the concession.

Concession: First Deserted, Then Directly Awarded

Addressing the businessman, the mayor reminded that the concession dates back to 2022. Although the tender was initially deserted, it was later awarded through a negotiated, non‑public procedure, a reference to the previous municipal administration.

“The operator has had more than enough time to regularise the activity and the provision of services in a public space,” de Vera concluded.

Owner’s Claim of “Persecution” Threatening Eight Families

Álvaro Sanz opened the venue in mid‑October 2025 under the commercial name Casa del Cuartel, employing eight workers—the breadwinners of eight families.

He acknowledges the incomplete documentation and the 2022 concession date but blames the delay in opening on the council’s failure to provide required services, specifically the bathrooms, which he says are the council’s responsibility.

“In September we met with the mayor, the urban planning staff and the contracting department. They committed to install the bathrooms, and we agreed to provide portable facilities in the meantime,” Sanz explained. Those portable services have been operating since the opening.

Alleged Municipal Persecution Extends to Discoteca Camelot

Sanz also alleges that the municipality has pursued an “arbitrary persecution” of his other business, Discoteca Camelot, which he has operated since 2023:

“That discotheque was chased week after week.”

He claims that continuous sealings have resulted in a favourable judicial ruling that awarded a substantial compensation, which he says the municipality will have to pay. He expects a similar outcome for El Patio del Cuartel and has requested court measures to lift the seal on the kiosk and its terrace.
